Unemployment Insurance DLLR letter

 

You will find, via the link on MD Justice, the letter that we mailed to DLLR today relative to UI concerns.  Thanks to all who contributed to the final product.  Anticipating that the next step will be a meeting with Squire, Howie and Smylie, let's start assembling our facts.  We should be ready with the following (whether we divulge names or not will be decided later);

1. CASES WHERE UI Emergency Benefits caused re-opening or re-visiting of initial determinations (Conni?);

2. CASES WHERE part time work exit disqualified a UI "full-time" claimant (Alecia?);

3. NO RELIEF IN OVERPAYMENT REQUESTS (all?)

4. INADEQUATE ACCESS TO UI FILES (Sally?  Others?)

5. PRECEDENTIAL EFFECT TO BOARD decisions that do not have substantive factual findings and legal conclusions (Peter);

6. HEARING DECISIONS where factual findings are not supported by text & conclusions not linked to factual findings (All);

7. HEARING PROCEDURE PROBLEMS--exclusion of witnesses, no closing argument, pacticing without a licensce, two hearings on same phone line (Alecia, Carol A, ? Others?)

8.  TREATMENT OF PRO SE CLAIMANTS -- bring the CDs [Peter, Alecia, others?]

9.  EMPLOYER BIAS in re-opening claims, second bites at the apple, pro se hearings, failure to record hearings (Lou?  Ferdi?  All?)

10. BOARD OF APPEAL REVIEWS -- length of time [Alecia?  All?] 

Experience with AGs at DHR on issues such as these indicates we should have our stories (and names of claimants and/or hearing examiners) ready.  We'll have a pre-meeting meeting, of course, but let's come to that with decisions, accounts, CDs ready.
